Townsend Family Law Solicitors : Cohabitation Disputes

Cohabitation Disputes

Where parties have been living together and their relationship breaks down, many couples expect the Courts to have the same powers to deal with property as married couples with many people referring to the fact that they are "common law husband/wife". This is far from the true picture however, as the Courts have far less flexible powers to deal with cohabitees.

We can offer help to clients prior to the commencement of cohabitation by drafting an agreement setting out how property will be dealt with upon a relationship breakdown. We also offer advice and representation in relation to the following:

  • Defining the share/interest the cohabitee has in the property
  • Applications for sale in relation to the property
  • Injunctions
  • Rights of occupation
  • Tenancies
  • Taxation
  • Applications under the Children Act
  • Ownership and use of chattels
  • Co-habitation Agreements
